Photo booth rental agreement

1. Parties and Scope

This Rental Agreement ("Agreement") is between PhotoBooth Moments ("Company", "we", "us") and the customer named on the accompanying quote ("Customer", "you"). It covers the open-air photo booth rental, attendant, backdrop, props, prints and any add-ons listed on the quote.

By clicking "Accept" on the quote email, you agree to this Agreement in full. Only the hours, backdrop and add-ons listed on the quote are included; anything added on the event day is billed at our standard rates.

2. Pricing, Travel and Setup Fees

Package pricing is based on the number of booked hours. Travel and setup fees depend on your venue's location, access, parking, load-in distance and setup window, and are confirmed by us after we review your request. Your booking stays pending until we send the final quote with those fees included.

Additional charges may apply for: idle hours between coverage blocks, extra hours added on the event day, venue parking, tolls, elevator or load-in delays caused by the venue, and damage to equipment or props. Applicable taxes are added where required.

3. Deposit and Payment

A deposit may be required to hold your date and is credited toward the balance. The remaining balance is due on or before the event day unless written terms are agreed in advance. We accept e-transfer, credit and debit.

Dates are held only once the quote is accepted and any required deposit is received.

4. Venue, Space and Power

You are responsible for securing a level indoor or covered space of roughly 10 ft x 10 ft with access to a standard grounded power outlet within 15 feet of the booth, plus permission from the venue for us to operate.

Setup begins up to 60 minutes before your start time and teardown takes about 45 minutes; neither counts against your booked hours. If the space, power or venue access is not ready at the agreed time, lost coverage is not refunded or extended.

5. Cancellation and Rescheduling

You may reschedule once, subject to availability, with at least 14 days' notice. Cancellations made more than 14 days before the event release you from the balance; deposits are non-refundable as they reserve your date.

If we cannot perform due to equipment failure, illness, severe weather or other events beyond our control, our liability is limited to a full refund of amounts paid.

6. Conduct and Equipment

Our attendant may pause or end service without refund if guests behave unsafely, damage equipment, or if the attendant is subjected to harassment or unsafe conditions.

You are responsible for the cost of repair or replacement of equipment or props damaged by you or your guests.

7. Photos, Privacy and Marketing

You receive a digital gallery of all photos taken at your event. We may use event photos in our portfolio, website and social media unless you tell us in writing before the event that you prefer we do not.

Guests who use the booth consent to being photographed. We do not sell personal information.

8. Liability

Our total liability for any claim arising from this Agreement is limited to the amount you paid for the rental. We are not liable for indirect or consequential losses.

9. Governing Law

This Agreement is governed by the laws of the Province of Ontario and the federal laws of Canada applicable there. If any provision is found unenforceable, the rest stays in force.

This Agreement, together with the accompanying quote, is the entire agreement between the parties. Your emailed acceptance of the quote is a binding electronic signature.
